Draft regulations released for comment

Four pieces of draft regulations released

SOUTH AFRICA: The Department of Transport released four separate pieces of draft regulations during the last week of December focusing on fishing vessel construction, fisher welfare and radio installations.

According to the preamble to the of the Merchant Shipping (Radio Installations) Regulations 2025, the Minister of Transport, Barbara Creecy intends to repeal the current radio installation regulations and is seeking public comment on the new draft regulations.

The copies of the Draft Merchant Shipping (Construction and Equipment of Fishing Vessels of 24 metres in length and over) Regulations 2025 as well as the Draft Merchant Shipping (Construction And Equipment of Fishing Vessels of less than 24 metres in length and equal to more than 25 GT) Regulations 2025 that are available on the South African Maritime Safety Authority’s website still appear to contain comments and annotations made by personnel working on the new rules.

Also up for comment are the Draft Merchant Shipping (Fisher Labour Welfare) Regulations 2025 which aim to give effect to the Work in Fishing Convention 2007.

WITHDRAWN: 

The processing of the Merchant Shipping Bill 2023 had been withdrawn from parliament to allow the Department of Transport to finalise the National Economic Development and Labour Council (Nedlac) process.
